My husband owes the irs 4200 for 2006. If he signs the installment, will they take our refund?

We filed jointly for 2006. We are 6 weeks from being divorced. I was going to file jointly and we were going to split the refund this year. But, now I'm wondering if I should file separate because he owes them money and I filed jointly with him so im uming even though it was his income they have a problem with, they could get me for it even though we will be divorced shortly. Can they take our refund? I've just heard bad stories and now I'm scared to file a return. What they sent us was just asking for an installment agreement or full payment, but will they hold our refund? My power has been off for 2 weeks and i'm in desparate need for money, but i don't know what to do about this.
